Information We Collect and How We Use It
We use commercially reasonable efforts to ensure that the collection of Personal Information is limited to that which is necessary to fulfill the purposes identified below. If we use your information in a manner different than the purpose for which it is collected, then we will ask you for your consent prior to such use.
Account information. If you create an account to take advantage of the services offered on the GroupToast Site, we ask for and record Personal Information such as your name, email address, and cell phone number. We use your email address to send you updates and reminders about your event, and contact you on behalf of other users (such as other users who send you personal messages or comments). You may choose not to receive e-mail of this type by updating your notification settings. We use your cell phone number to send you updates and reminders about your party. You may choose not to receive text messages from us by updating your notification settings. Unless you notify us not to contact you via e-mail or text message, your use of our Site constitutes your assent to contact from GroupToast via such means.
Submissions. We store and publicly display your content in order to provide the services that we offer. When we display your content, we do so together with your account name and full name. The term "content" refers to the information that you submit or post to the GroupToast Site for public display, such as photos, status, comments, date of birth, and the information that you display as part of your account profile.
Information about others. We may also collect and store Personal Information about other people that you provide to us. You may use our website to send others, such as your friends, relatives, or co-workers, invitations or messages through our website. Accordingly, we may store the Personal Information of the recipient of your invitations or messages. In addition, we may, at your request, use the contact information of your friends, relatives, or co-workers that you supply to us to send them emails or text messages as reminders of your event. We may use the contact information to allow them to respond to and comment on your invitation and your event. If you are a guest to an event or an invitee, and wish to not receive future communications from us, please follow the instructions contained in our original communication to you.
Feedback. If you contact us to provide feedback, register a complaint, or ask a question, we will record any Personal Information and other content that you provide in your communication so that we can effectively respond to your communication.
Personal messaging. In order to allow you to send and receive personal messages to other registered users of GroupToast, we record the messages that you send and receive using the GroupToast personal messaging feature.
Log Files. Any time you visit any of our websites, our servers automatically gather information from your browser (such as your IP addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks) to analyze trends, administer the site, prevent fraud, track visitor movement in the aggregate, and gather broad demographic information. For example, we may log your IP address for system administration purposes. IP addresses are logged to track a user’s session. This gives us an idea of which parts of our site users are visiting. We do not share the log files externally.
Cookies. We send cookies to your computer in order to uniquely identify your browser and improve the quality of our service. The term "cookies" refers to small pieces of information that a website sends to your computer's hard drive while you are viewing the site. We may use both session cookies (which expire once you close your browser) and persistent cookies (which stay on your computer until you delete them). Persistent cookies can be removed by following your browser help file directions. If you choose to disable cookies, some areas of GroupToast may not work properly or at all.
Web Beacons. “Web beacons” (also known as “clear gifs” and “pixel tags”) are small transparent graphic images that are often used in conjunction with cookies in order to further personalize our website for our users and to collect a limited set of information about our visitors. We may also use web beacons in email communications in order to understand the behavior of our customers. We do not link the web beacons to any Personal Information.
Information About You. When you register or subscribe to any of our services, we collect a wide variety of information about you, including but not limited to your first and last name, email address and phone number.
Purchase Information. To process registrations or subscriptions, we may require your name, address, phone number, email address, and credit card information. Such information is used primarily to process your order or as otherwise described herein. Credit card transactions are processed through industry standard Secure Socket Layer (SSL) and/or strong encryption (3DES) by a third party, which only uses your information for that purpose.
E-mails and Phone Numbers. We require an e-mail address from you when you register for our services. We use your e-mail for both transactional (e.g., order confirmation, renewals) and promotional (e.g., newsletters, new product offerings, special discounts, event notifications, special third-party offers) purposes. E-mail messages we send you may contain code that enables our database to track your usage of the e-mails, including whether the e-mail was opened and what links (if any) were clicked. If you would rather not receive promotional e-mails from us, please see the section below labeled “Choice:Opt-In/Opt-Out”. We reserve the right to send you certain communications relating to GroupToast’s Services, such as service announcements and administrative messages, without offering you the opportunity to opt out of receiving them.
We may also contact you by telephone or text message (including to any wireless number you may provide to us) solely in connection with GroupToast’s services. We will not contact you via telephone or text message without your express consent. As such, you must Opt-In if you would like to be contacted via telephone or text message. Data rates and fees for text messages and phone calls may be charged to you by your wireless provider for phone calls or text messages. We are not liable for and will not reimburse you for any fees charged to you by your wireless provider. If you Opt-In, and then later decide that you would rather not receive telephone calls or text messages from us, you may change or delete your number from your account preferences page(s), or ask to be removed from our contact list if you receive a call or text message from us. Please see the section below labeled “Choice:Opt-In/Opt-Out” for further information. We fully comply with the requirements of the U.S. CAN-SPAM Act.
Demographic Data. Demographic data is also collected at our site. We use this data to tailor our visitors’ experience at our site, showing them content that we think they might be interested in, and displaying the content according to their preferences. Some of this information may be shared with advertisers on a non-personally identifiable basis.
Public Forums and Profiles. We may make discussion boards and profiles available to our users and visitors. We do not make available any Personal Information on discussion boards, but you have the option to disclose such information if you choose. Any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose any Personal Information.
Transfer of Information
We may distribute your content to other members of GroupToast and third parties as permitted pursuant to our Terms of Service. For instance, we will share your Personal Information, such as your name and contact information, with the venue that is hosting your event. The other members and third parties may in turn publicly display or publish your content in connection with their own profiles.
We may share your Personal Information with third parties to provide you with services that we offer through GroupToast, conduct quality assurance testing, facilitate creation of accounts, provide technical and customer support, or provide specific services, such as synchronization of your contacts with other software applications, in accordance with your instructions. These third parties are required not to use your Personal Information other than to provide the services requested by you.
We may disclose information in the aggregate to third parties relating to user behavior in connection with actual or prospective business relationship with those third parties, such as advertisers and content distributors, but no individual information will be disclosed along with such aggregated information. For example, we may disclose the number of users that have been exposed to, or clicked on, advertising banners.
We use third party advertising companies to serve ads when you visit the GroupToast Sites. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you. These companies may employ cookies and web beacons to measure advertising effectiveness.
The GroupToast Site may contain advertisements or other content that link to third party websites to which we have no affiliation. Except as set forth herein, we do not share your Personal Information with those third parties, and are not responsible for their privacy practices. We suggest you read the privacy policies on all such third party websites.
Controlling Your Personal Data
To the extent you include Personal Information in your submissions (such as a photo of yourself), third parties may be able to identify you, associate you with your user account, and contact you. Third parties can also associate you with your user account using the lookup feature on the GroupToast Site, but only if the third party already knows your full name and you include information in your submission that allows the third party to distinguish you from other users who might share the same full name. Please do not include information in your submissions that you expect to keep private. In addition, you can reduce the risk of being personally identified by choosing a fictitious account name.
Please also note that the personal messages you send or receive using the GroupToast Site's personal messaging feature are only private to the extent that you and the sender/recipient keep them private. For example, we do not have any control over whether a recipient of one of your personal messages publicly posts the contents of such a message.
As a registered GroupToast user, you can modify some of your Personal Information and your privacy preferences by accessing the "Account" section of this website. For example, you may choose not to receive e-mail solicitations from GroupToast by accessing the "Account" tab on the GroupToast Site and updating your notification settings. Upon your request, GroupToast will use commercially reasonable efforts to close your account, and cease displaying your submissions on the GroupToast Site; nevertheless, we may still retain your Personal Information in our systems.
You hereby acknowledge that GroupToast is not responsible for any intercepted information sent via the internet, and you hereby release us from any and all claims, damages, costs, liabilities and expenses (including actual attorney’s fees) arising out of or related to the use of intercepted information in any unauthorized manner.
By default you will not receive notifications via text message or telephone. You may Opt-In to receiving notifications from us via text message or telephone. You understand that if you do Opt-In, you will be responsible for any charges assessed to you by your wireless provider for your receipt of text messages or phone calls.
Please understand that you must allow us to contact you through at least one of the following means: via email or via text message. If you do not permit contact via one of these methods, then you are not permitted to use the services of GroupToast.

Contacting the Website and Access to Your Personal Information
Upon written request, subject to certain exceptions, GroupToast will inform you of the existence, use, and disclosure of your Personal Information and will give you access to that information. Access requests should be sent to our Privacy Officer using the contact information above. When requesting access to your Personal Information, we may request specific information from you to enable us to confirm your identity and right to access, as well as to search for and provide the Personal Information that we hold about you. We may charge you a fee to access your Personal Information to cover our costs; however, we will advise you of any fee in advance, which will be no more than any maximum fee prescribed by law.
